REPRESENTATIVE MATTERS
SURFACE TRANSPORTATION / LOGISTICS

Representing motor carriers, bus lines, household goods carriers, freight forwarders,
transportation brokers and railroads in complying with licensing and
related requirements of federal administrative
agencies and bodies such as the U.S. Department of Transportation's Federal
Motor Carrier Safety Administration (FMCSA), Surface Transportation
Board and Bureau of Transportation Statistics, as well as the
requirements of state and local bodies such as
the Railroad Commission of Texas, the Texas Department of Transportation and the cities of
Austin, Dallas, Houston and San Antonio, Texas.

Expanding operations internationally for motor carriers, bus lines, household goods
carriers, freight forwarders, third and fourth party logistics providers, vehicle leasing companies and companies
providing services to the surface transportation industry (such as a major provider of
emergency recovery and accident containment service to the railroad industry).

Defending motor carriers, bus lines, household goods carriers, vehicle leasing and
rental companies, manufacturers of trucks and trailers and their insurers against personal
injury and property damage claims arising out of highway accidents and other
incidents.

Defending railroads and their insurers in railroad crossing accidents and against other
personal injury and property damage claims asserted by motorists, by pedestrians and by
trespassers.

Representing railroads and their insurers in connection with personal injury claims
brought by employees under the Federal Employers' Liability Act, including claims under
the Safety Compliance Act and claims under the Boiler Inspection Act.

Representing motor carriers, bus lines, household goods carriers, freight forwarders,
transportation brokers, customs brokers, railroads, warehouses, consolidators, third party
logistics providers, shippers and their insurers in litigation involving cargo loss and
damage disputes and collection of freight charges.

Representing motor carriers, household goods carriers, freight forwarders, railroads,
transportation brokers, warehouses, consolidators, third and fourth party logistics providers and
shippers in negotiating and drafting transportation and logistics contracts.

Representing railroads in disputes concerning the interpretation of railroad trackage
agreements and concerning other contract disputes between railroads.

Representing motor carriers and household goods carriers in negotiating and drafting
service agreements with independent contractor owner operators.

Representing motor carriers, bus lines and household goods carriers in safety,
hazardous materials and other enforcement, penalty or administrative proceedings before
agencies of the U.S. Department of Transportation
including the FMCSA, the Research and Special Programs Administration, the Surface Transportation Board and the
Federal Railroad Administration, as well as before the Texas Department of Transportation, the Texas
Department of Public Safety and the Railroad Commission of Texas.

Advising motor carriers, bus lines, household goods carriers,
freight forwarders and railroads concerning applicable federal and
state regulations such as those pertaining to safety of operations,
hazardous materials transportation, commercial driver's licenses and
registration of vehicles.

Representing motor carriers in applying for and obtaining
disadvantaged business enterprise ("DBE") certification and
in applying for and obtaining historically underutilized business
("HUB") certification from the Texas Department of
Transportation.

Defending shippers and transportation brokers against claims by trustees of bankrupt
motor carriers to collect alleged freight undercharges.
-
Advising and representing motor carriers, freight forwarders, railroads, shippers and
their insurers in connection with spills of hazardous materials.

Representing motor carriers, bus lines and household goods carriers in the preparation
and implementation of safety and drug testing programs.

Advising and representing motor carriers, bus lines, household goods carriers and
railroads in connection with issues concerning taxation of truck tractors, semi-trailers,
locomotives and railcars, and in connection with other taxation matters at the local,
state, federal and international level.

Advising and representing motor carriers, bus lines, household goods carriers and
railroads on customs and immigration issues and in customs and
immigration enforcement matters.

Representing motor carriers, bus lines, household goods
carriers, freight forwarders, railroads, transportation brokers, third
and fourth party logistics providers and shippers in connection with
international matters in Mexico, Latin America, Canada, Europe and other countries.

Advising motor carriers on the drafting and design of Web site
based bill of lading forms, and concerning the proposed
"OAS" bill of lading for shipments to and from Central and
South America.

Advising and representing motor carriers, bus lines, household goods
carriers, freight forwarders, railroads, transportation brokers and
third and fourth
party logistics providers in
connection with the formation and implementation of e-commerce
services on the Internet such as Web site based load matching services
and other logistics services.

Mediation and arbitration of surface transportation disputes.

Legislative monitoring, drafting and advocacy in Washington, D.C.

Monitoring and participating in rulemaking proceedings before
governmental agencies regulating transportation and related matters in
Washington, D.C.
