This change is the first part of a three-stage increase. The minimum wage will increase again on July 24, 2008 to $6.55 per hour and again on July 24, 2009 to $7.25 per hour. The $2.13 hourly wage for "tipped employees" will not change. Simultaneous with this change, all employers subject to the Fair Labor Standard Act's ("Act's") minimum wage provisions must post an updated notice explaining the Act in a common area of each establishment of the Employer such as a break room or bulletin board. Posters may be downloaded free of charge from the Department of Labor (DOL) website. This email Alert is only a summary of changes to the wage and hour law. Employers with any questions about the new minimum wage or other wage and hour issues should seek the advice of counsel.
