Throughout its history, Strasburger has had an extensive practice involving the defense of personal injury and property damage cases based on tort theories of recovery, including negligence, gross negligence, products liability, workplace injury and intentional tort claims. PREMISES LIABILITY

The firm represents a wide variety of clients in liability cases arising from accidents and violent crimes on commercial property. Partners and associates have a broad working knowledge of this area of the law, which continues to evolve as Texas courts render new opinions based upon continuing and novel arguments of the plaintiffs' bar in seeking "deep pockets" to pay for injuries inflicted by allegedly dangerous premises and criminals. Strasburger has defended claims arising from violent crimes which occurred at ATMs, apartment complexes, banks, convenience stores, fast food restaurants, shopping malls, motels, restaurants, gas stations and airports. Firm attorneys regularly participate in national and regional seminars on the defense of these cases. In addition, the firm regularly handles traditional premises liability cases, such as those involving slip and fall incidents, attractive nuisance claims and accidents involving independent contractors.

  

TRANSPORTATION

The firm's transportation attorneys have knowledge in railroad, trucking, boating and aviation litigation. These attorneys have represented national motor carriers, including tank, bulk, household goods carriers and their insurers, as well as manufacturers of tractor/trailer equipment in cases involving all facets of personal injury, property damage and cargo claims litigation. Additionally, we have represented many transportation clients in administrative proceedings before the Texas Motor Vehicle Commission, in the bankruptcy and restructuring of truck dealerships and in filed rate disputes. Attorneys also represent clients in matters arising under maritime laws and admiralty jurisdiction of the various federal and state courts.

  

WORKPLACE INJURY

Lawyers handling tort liability issues have considerable experience in lawsuits arising from incidents in the workplace, including claims arising from workers' compensation, false arrest and false imprisonment, defamation and on-the-job injuries. Our lawyers have successfully defended hundreds of cases resulting from personal injuries of all types, including many cases tried to jury verdict for property owners, business occupiers of premises, workers' compensation insurance carriers, self-insured employers and non-subscribing employers.

  

MASS TORT

For more than twenty years, attorneys at Strasburger have represented clients in multi-claim cases requiring specialized litigation teams. Mass tort matters often include thousands of plaintiffs and multiple defendants. Partners and associates have extensive experience in directing the strategic planning, case management, and technical support necessary to manage the numerous cases involved in a complex mass tort whether it includes a toxic exposure, defective product claim, or other personal injury related claims. To successfully manage these complex matters, the firm uses the latest computer technology for database management, document imaging, email communication, and electronic transfer systems that allow documents to be stored on CD-ROM for retrieval during a trial. In the past, the firm has been involved in mass tort litigation involving a food supplement, breast implants and diet pills.

  

CASE RESULTS

  • Obtained a complete defense verdict in a premises liability suit arising from a fight in a parking lot between a convenience store clerk and several customers. The plaintiff had sought to recover over $13 million in damages for alleged head injuries.
       
  • Successfully defended a suit seeking more than $20 million in damages asserted by nine plaintiffs who alleged they became ill due to a building renovation project. After a three-month trial, the firm obtained a complete defense verdict.
       
  • Successfully defended a personal injury suit arising from a shooting incident at a fast food restaurant. The case was tried in federal court, and the plaintiff alleged the loss of use of one arm.
       
  • Obtained a defense verdict in the trial of an injury claim resulting from an attempted robbery and shooting an outdoor ATM (automatic teller machine) at a bank.
       
  • Obtained numerous defense verdicts in the past two years on behalf of non-subscriber employers being brought by employees, despite the argument that only one percent of negligence would subject the employer to payment of damages.
       
  • Obtained defense verdicts and resolutions of slip and fall claims on behalf of premises owners on a cost sensitive basis.
       
  • Obtained a dismissal of all claims against a fast food restaurant in connection with the shooting death of a patron at a shopping mall food court.
       
  • Defended a number of sexual assault claims at various apartment complexes throughout Texas in the past two years. All of them have resulted in outcomes favorable to our clients.
       
  • Obtained a summary judgment on behalf of a physicians' association in a $2 million defamation claim filed by a doctor.
      
  • Won a unanimous jury verdict in Federal Court in the Northern District of Texas involving claims of copyright infringement and defamation (2004).
     
  • Obtained summary judgment for a national newspaper publisher in a wrongful death suit resulting from an automobile accident involving one of the newspaper's distributors (2003).
     
  • Obtained summary judgment for a workers' compensation insurance carrier and third party administrator from a Dallas Federal Court in an insurance bad faith and wrongful death suit, successfully convincing the Court that North Carolina, as opposed to Texas law, applied (2002).
     
  • Obtained summary judgment from an Albuquerque, New Mexico Federal Court in a defamation suit brought against a physician organization by a former member of that organization who was accused in a professional publication of stock fraud (2000).
      
  • Successfully defended Hartford in a suit brought in Dallas County State Court by several former insured employers who alleged that Hartford had mishandled their workers' compensation claims, thereby causing their insurance premiums to escalate. The jury rejected those contentions and rendered a verdict for Hartford (1998).
