CONTRACT NEGOTIATIONS

Strasburger frequently represents clients in negotiating and drafting construction contracts, including providing analysis and advice on relevant issues such as indemnity provisions and insurance requirements and negotiating and drafting language relating to progress and final payments, project closeout and warranty provisions. During contract negotiations, our lawyers understand the need to negotiate a reasonable contract while maintaining a good working relationship with the other contracting parties.

  

PRE-SUIT DISPUTE RESOLUTION

Strasburger understands that construction clients need an efficient plan to resolve disputes that does not disrupt ongoing construction projects or escalate already tense situations. Consequently, our construction attorneys are experienced in the quick and cost effective investigation of disputes, and thereby use that expertise to negotiate a prompt and equitable resolution.

  

LITIGATION / ARBITRATION

When litigation is inevitable or advisable, our attorneys are well qualified and well staffed to handle the matter through discovery, trial, and appeal, if necessary. Litigation matters commonly handled involve claims for defects in construction, design, and related products, claims for delay, claims for payment, mechanic’s lien disputes, payment and performance bond claims, warranty claims, and completion claims. Our lawyers are also experienced in handling matters involving consumer fraud, deceptive trade practices and express and implied warranty claims, which are typically asserted in today’s consumer oriented environment.

  • Negotiation and drafting of a series of contracts with architects and contractors involving a renovation and expansion campaign for a non-profit owner;
  • Negotiation and drafting of a $12 million construction contract for the renovation and expansion of a manufacturing plant;
  • Preparation of Standard Form Construction Contracts for use in Texas by a large commercial developer;
  • Representation of a public entity in the resolution of claims resulting from a 22,000 square foot defective terrazzo floor;
  • Representation of a developer in the resolution of claims and close out of three projects involving the design and construction of assisted living facilities;       
  • Representation of a private commercial owner in the resolution of multiple mechanics liens;
  • Advice to a private owner regarding the investigation and repair of a newly constructed concrete slab of a manufacturing facility;
  • Defense of a commercial general contractor to claims involving the construction of a roof system of a prominent Dallas hotel;
  • Defense of a commercial general contractor to claims involving an exterior masonry system of a large Dallas hotel; and
  • Defense of a commercial general contractor to claims involving the asphalt paving design and construction of a large storage yard for mobile modular buildings.
