Mediation and Arbitration

A key component of any successful litigation practice is the ability to help clients solve legal disputes efficiently. In every instance, Strasburger & Price, LLP believes in keeping clients out of the courtroom whenever possible and resolving disputes before they develop into full-blown problems. Virtually all of our litigation attorneys have extensive experience in the use of mediation and arbitration. This experience, combined with our trial expertise, often allows us to favorably resolve problems for our clients well before trial.

THE BENEFITS OF ALTERNATIVE DISPUTE RESOLUTION

The alternative dispute resolution (ADR) process often provides convenient and simplified proceedings, speedy results, solid solutions, and substantial time savings. These efficiencies can reduce legal fees and related costs. In addition, many clients do not enjoy relinquishing control to a judge or jury. The ADR process offers increased control over the dispute and the results. Furthermore, mediators and arbitrators generally have expertise in the subject matter of the dispute.

Under applicable rules, mediators, arbitrators, and dispute resolution agencies are generally obligated to maintain the privacy and confidentiality of the proceedings. The parties themselves may also agree to confidentiality. This may avoid publicity and embarrassment to the parties involved.

Disputing parties who have a valuable working relationship or a business partnership may benefit from working together to achieve a mutually acceptable resolution to their dispute. Parties who understand each other's concerns and develop satisfactory solutions to address these concerns often improve their relationship and enhance their ability to work together in the future.

EXPERIENCE SERVING AS CLIENT ADVOCATES

Strasburger takes great pride in its ability to effectively manage legal costs and disputes without going to court. At the outset of every engagement, we endeavor to discuss goals, fees, timelines, and options for using various ADR processes with clients. When appropriate, we recommend using ADR to avoid the time and expense of using our increasingly overburdened court system.

With more than 30 different practice areas firmwide, Strasburger offers clients the advantage of seasoned attorneys who handle a multitude of matters. This advantage allows us to draw upon the knowledge and skills of 200 attorneys in seven different offices. Our attorneys have successfully represented clients in literally thousands of complex disputes involving business contracts, construction claims, environmental liabilities, hospitals, insurers and reinsurers, oil and gas transactions, product liability, operation agreements, real estate transactions, tax issues, property claims, and transportation/logistics, among many others.
