A significant increase in the number of professional liability suits is a direct result of today's litigious atmosphere. Many different types of professionals—including doctors, lawyers and accountants, to the name the most obvious—are facing a rise in malpractice suits. These suits can not only make or break careers, but also the companies for which these individuals work. Our attorneys understand that the outcome of a dispute or trial can have drastic ramifications for individuals, partnerships, practices and companies.

  • Defense verdict in an attorney malpractice claim involving a Stowers demand. (State Court-Dallas)
  • Obtained summary judgment on behalf of a lawyer sued by a former client for alleged negligence in failing to obtain a restraining order against the client's former spouse. The former spouse in a rage shot his children and killed himself.
  • Defense verdict in an attorney malpractice claim alleging mishandling of the client's lawsuit and excessive fees. (State Court-Upshur County)
  • Obtained summary judgment for a family law firm accused of disclosing confidential information that allegedly caused the failure of a $15,000,000 securities placement.
  • Defense verdict in attorney malpractice action alleging negligence in the handling of suit. (State Court-Dallas)
  • Obtained summary judgment in a lawyer malpractice action arising from a Chapter 11 bankruptcy proceeding in which over $3,000,000 in damages were sought.
  • Obtained voluntary dismissal for an attorney serving as counsel to a closely-held corporation in which securities fraud, breach of fiduciary duty and negligence were alleged and damages of more than $2,000,000 were sought.
  • Defense verdict in attorney malpractice claim. (Probate Court-Fort Worth)

  

INSURANCE AGENTS

  • Defense verdict for an agent accused of failing to report a suit against the insured to a carrier. (State Court-Dallas)
  • Obtained nonsuit for an insurance agent sued by a physician who was denied disability payments from an insurer.
  • Obtained dismissal for lack of personal jurisdiction for an insurance agency sued in federal court for alleged misrepresentations relating to CGL policies.
  • Defense verdict for an insurance agent sued because of the agent's alleged failure to obtain contents coverage for the insured's business; agent prevailed on bad faith counterclaim entitling him to recover all his attorneys fees. (State Court-Dallas)

  

DIRECTORS, OFFICERS, AND FIDUCIARIES

  • Obtained summary judgment—affirmed on appeal—for an insurer sued by the FDIC seeking a declaration of coverage.
  • Obtained summary judgment for a directors and officers insurer in a suit brought by a former bank officer seeking indemnification for fees incurred in his successful defense of an indictment for money laundering and damages.
  • Defended and successfully settled a lawsuit alleging misrepresentation and breach of fiduciary duty under ERISA filed by an Employees Investment Plan against administrative committee members.

  

ACCOUNTANTS

  • Obtained dismissal with prejudice for an accounting firm in a suit alleging fraud, negligence and DTPA violations brought by investors in municipal utility district bonds.
  • Obtained dismissal for want of personal jurisdiction—sustained on appeal—on behalf of a Utah accounting firm sued for allegedly misleading financial statements included in a Texas private placement memorandum.
