Litigation & Alternative Dispute Resolution

Our attorneys handle a wide range of health care litigation, including commercial litigation, medical liability disputes, and lawsuits such as mass torts and class actions. We counsel physician groups, hospitals, health care systems, rehabilitation facilities, laboratories, and other health care related providers. In addition, we represent drug and medical device manufacturers and distributors in lawsuits alleging defective or dangerous products.

Our extensive knowledge of state and federal regulatory requirements allows us to counsel clients on business organization, operations, transactions, joint ventures, mergers and acquisitions, and litigation.

We advise physicians and physician groups in all manner of transactions, including the creation of health care entities.  Our team is knowledgeable about health care businesses and assists in a variety of situations, from financing and construction needs to estate protection plans. We also routinely counsel clients throughout the licensing and credentialing maze.

Reimbursement entails a complex network of regulations at both the state and federal level.  We stay up-to-date on legislation and programs from Medicare and Medicaid regulations to rate setting and pay for performance, as well as advise on contemplated changes.

EXPERIENCE
Representative matters handled by Strasburger’s health attorneys include the following:
  • Acquisition of hospitals, physician practices, ambulatory facilities and creation of joint ventures for a large, non-profit health system based in Virginia.
  • Development of multiple long-term care hospitals for a Texas-based for-profit hospital company, and the subsequent sale of that entire company.
  • Creation of a Texas-based, non-profit health system through the affiliation of two hospital systems, and multiple other matters for the resulting system including joint ventures, structuring and sale of home health agencies, and development of long-term care hospital joint venture with physician partners.
  • Organization of physicians, private placement offering and acquisition of hospital out of bankruptcy.
  • Development of physician-owned hospital from acquisition of raw land to operating facility.
  • Assist physicians regarding investment interests in ancillary services including ASCs, MRIs and other diagnostic services and equipment.
  • Organization and implementation of physician-hospital organizations (PHOs) for purposes of contracting with payors and participating in Value Based Payment programs.
  • Incorporation and ongoing representation of a publicly traded entity that owns behavioral health facilities and is a leading manager of clinical services for acute care hospitals and employers, including in public stock offerings, periodic SEC filings and acquisitions of 15 behavioral health care facilities.
  • Represented an orthopedic spine surgeon and his practice against the plaintiff's allegations of unnecessary scoliosis revision surgery. The plaintiff, who was left partially paralyzed as the result of the surgery, sought $6 million in damages. We obtained a complete defense verdict for our client after a one week jury trial.
  • Received a unanimous complete defense verdict in Dallas County for our client in medical malpractice case where plaintiffs alleged that the obstetrician was negligent in the delivery of a baby who suffered a brachial plexus injury to her left arm at birth. The plaintiffs claimed approximately $3 million in total damages.
  • Handled appeal to Supreme Court of Texas resulting in a decision declaring that claims against hospitals for improper credentialing of physicians are "health care liability claims" under the Texas medical malpractice statute, art. 4590i.Garland Community Hospital v. Rose, 156 S.W.3d 541 (Tex. 2004).
  • Defended a multilevel marketing company selling vitamin supplements, where the arbitration claim exceeded $600,000. The arbitration panel reduced the award to 10% of the claimed amount, and denied the claimant's claim for attorneys' fees;
  • Successfully settled price-fixing complaint by Texas Attorney General against multiple physicians.
