EXPERIENCE

Attorneys

  • Obtained summary judgment for a family law firm accused of disclosing confidential information that allegedly caused the failure of a $15,000,000 securities placement.
  • Obtained a voluntary dismissal for an attorney serving as counsel to a closely-held corporation in which securities fraud, breach of fiduciary duty and negligence were alleged.
  • Defense of large out of state law firm in legal malpractice action brought by foreign investors in Texas real estate alleging negligence and breach of fiduciary duties.
  • Defense of major Dallas law firm in legal malpractice suit arising out of formation of business.  All claims against firm nonsuited at end of first week of trial.

Insurance Agents

  • Obtained nonsuit for an insurance agent sued by a physician who was denied disability payments from an insurer.
  • Defense verdict for an insurance agent sued because of the agent’s alleged failure to obtain contents coverage for the insured’s business; agent prevailed on bad faith counterclaim entitled him to recover all his attorneys’ fees.

Directors, Officers, and Fiduciaries

  • Obtained summary judgment – affirmed on appeal – for an insurer sued by the FDIC seeking a declaration of coverage.
  • Obtained summary judgment for a directors and officers insurer in a suit by a former bank officer seeking indemnification for fees incurred in his successful defense of an indictment for money laundering and damages.
  • Defense of lawsuit alleging misrepresentation and breach of fiduciary duty under ERISA filed by an Employees Investment Plan against administrative committee members.

Accountants

  • Obtained dismissal with prejudice for an accounting firm in a suit alleging fraud, negligence and DTPA violations brought by investors in municipal utility district bonds.
  • Obtained dismissal for want of personal jurisdiction – sustained on appeal – on behalf of a Utah accounting firm sued for allegedly misleading financial statements included in a Texas private placement memorandum.
