Pension & Employee Retirement

OVERVIEW

The firm’s attorneys have long represented some of the largest, as well as some of the more modest, governmental employer pension and health care systems in Texas. We are proud of representing some pension plans for almost 30 years. We help design and draft these plans to provide the right and reasonably affordable levels of benefits and to help our clients maintain their plans’ tax exempt status, provide guidance on taxation of distributions and assist many of our clients with regard to the negotiation and drafting of their investment contracts as well as provide training and education on fiduciary responsibility questions. We have successfully provided litigation help to a number of governmental and private sector employee pension, health and welfare benefit plans.

EXPERIENCE

Our employee benefit lawyers, working on pension, health care, executive compensation and plan investment matters may be helping clients:

  • Negotiate a 20 or 100 M investment contract, often for a large government pension plan
  • Help pension plans develop communication materials to assist employees in better preparing for their later retirement, whether it be with regard to a self-directed 401(k) plan or to become more informed on the interrelationship of their pension, private savings, the need for proper estate planning and the like,
  • Negotiate and draft 457(f) deferred compensation arrangements for executives
  • Help employers adapt and develop prefunding of retiree health care benefits using specialized trust vehicles
